Terms of Service

These Terms of Service (“Terms”) govern your use of the Bottle Hound mobile application and related services operated at bottlehoundapp.com (together, the “Service”). By creating an account or using Bottle Hound, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information and is incorporated by reference.

1. Eligibility

You must be at least 21 years old, or the legal drinking age in your jurisdiction, whichever is higher, to use Bottle Hound. By accepting the age gate on first launch (or otherwise using the Service), you confirm that you meet this requirement. The Service is not intended for anyone under that age.

2. The Service

Bottle Hound is a community tool that helps hunters discover whiskey bottles and pours at liquor stores and bars, share availability reports (“finds”), and set optional “unicorn” alerts. We do not sell alcohol. We do not operate retail stores or bars. Availability information comes from users and may be incomplete, outdated, or incorrect.

3. Accounts

You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it up to date. You may delete your account in the app; see the Privacy Policy for what we retain after deletion.

4. User content

Finds, photos, notes, and other content you submit (“User Content”) are your responsibility. You grant Bottle Hound a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that User Content as needed to operate and improve the Service (including showing finds to other hunters).

You agree not to upload or post content that is:

• Illegal, fraudulent, or misleading about product availability
• Infringing of others’ rights (including copyright or trademarks)
• Harassing, hateful, pornographic, or otherwise inappropriate
• Malware, spam, or an attempt to disrupt the Service

We may hide, remove, or restrict User Content or accounts that violate these Terms or that we reasonably believe harm the community or the Service.

5. Subscriptions (Hound Premium)

Optional paid features (“Hound Premium”) are billed through Apple App Store or Google Play. Pricing, renewal, and cancellation are controlled by those stores’ subscription settings. Bottle Hound cannot cancel a store subscription on your behalf. Refunds are handled by Apple or Google under their policies. Subscription status may be processed via RevenueCat as our billing infrastructure.

6. Acceptable use

You agree not to:

• Scrape, reverse engineer, or overload the Service except as allowed by law
• Impersonate others or misrepresent your affiliation
• Use the Service to facilitate illegal alcohol sales or underage access
• Interfere with other users’ enjoyment of the Service

7. Intellectual property

Bottle Hound branding, app design, and original content (excluding User Content and third-party marks) are owned by us or our licensors. Distillery and brand names appearing in the catalog are trademarks of their respective owners and are used for identification of products hunters may encounter in the wild.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that finds are accurate, that a bottle will still be on the shelf when you arrive, or that the Service will be uninterrupted or error-free. Drink responsibly.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTTLE HOUND AND ITS OPERATORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PREMIUM IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnity

You agree to indemnify and hold harmless Bottle Hound and its operators from claims arising out of your User Content or your violation of these Terms, to the extent permitted by law.

11. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate access if you violate these Terms or if we discontinue the Service.

12. Changes

We may update these Terms. We will change the “Last updated” date above and, when appropriate, provide notice in the app or on our site. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States and the State of New Jersey, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply.
